Agreement to Terms

By purchasing, downloading, or using Smooth Capture, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the software.

License Grant

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Smooth Capture for your personal or commercial purposes.

License Scope

  • You may use Smooth Capture on one Mac at a time. Activating on a new device will automatically deactivate your previous device
  • You may use Smooth Capture to create unlimited videos for personal or commercial use
  • You may not share, rent, lease, or distribute your license to others
  • You may not reverse engineer, decompile, or disassemble the software

Lifetime License

Your lifetime license grants you:

  • Perpetual use of Smooth Capture
  • All major and minor updates
  • Technical support via email
  • No recurring fees or subscriptions

Note: A "lifetime license" means for the lifetime of the product, not the lifetime of the user. We reserve the right to discontinue the product, though we will provide reasonable notice.

Prohibited Uses

You may not use Smooth Capture to:

  • Create content that violates any applicable laws
  • Infringe on intellectual property rights of others
  • Record private communications without consent
  • Create malicious or harmful content
  • Circumvent license validation or copy protection
  • Resell or redistribute the software

Intellectual Property

Smooth Capture and all related trademarks, service marks, logos, and trade names are proprietary to us. You own all rights to the content you create using Smooth Capture. We do not claim any ownership or rights to your recordings or projects.

Refund Policy

We offer a 30-day money-back guarantee. If you're not satisfied with Smooth Capture, contact us within 30 days of purchase for a full refund. After 30 days, all sales are final.

Disclaimer of Warranties

SMOOTH CAPTURE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.

Updates and Modifications

We may update Smooth Capture from time to time. Updates may include bug fixes, new features, or improvements. We may also modify these Terms of Service at any time. Continued use of the software after changes constitutes acceptance of the modified terms.

Termination

We reserve the right to terminate or suspend your license if you violate these terms. Upon termination, you must cease all use of Smooth Capture and delete all copies from your devices.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to conflict of law principles.
